I do agree with whomever suggesting that in this case and the Zimmerman case, the outrage may have caused people to be overcharged and thus walked away scot free. If the charges were different, these people might have gone to jail.

The burden of proof is on the prosecution to prove their case to the exclusion of all reasonable doubt. If they can't do that the defense walks.

Not only the overcharging but also the rush to judge ment, particularly in the Zimmerman case. They went to trial without enough evidence to prove any crime. To convict, you have to establish beyond a reasonable doubt what was the sequence of events between the time Zimmerman got out of his car and Martin was dead. Whatever crime you could convict for would depend on exactly what that sequence was. Without establishing that sequence, you can't prove any crime, except possibly negligent homicide if you can establish that getting out of the car was negligent enough to make somebody's death highly likely if not inevitable. I don't know if a jury buys that or not.
