He probably just mis-spoke, or perhaps his point was that with an intelligent person like Scalia on the court to aggressively argue the case from a different perspective, that another could be swayed. I doubt it, but it's certainly possible.

I think he probably was half listening when he was briefed, and just assumed that it was another one of those ties we've been seeing. It is another example of sleep deprivation. I think if Trump would simply get a couple more hours of sleep, listen to his handlers, and stop shooting from the hip he would come across as much more competent.

Well first of all, Kennedy might have voted a different way if was a 4-4 tie to begin with. One of the reasons he sided with the majority was perhaps he didn't want that Texas law being sent back to the lower courts. So I'll give Trump the benefit of the doubt on this one.
Of course if Trump was president when Scalia died, the Republican-controlled Senate wouldn't have a hearing on his replacement either, riiigghttt???
And by the way, I'm ashamed to say I've seen Trump in action many, many times when he wasn't sleep-deprived (too many Apprentice and Celebrity Apprentice viewings), and he's always going to be shooting from the hip and saying things he shouldn't. He needs to follow Obama's lead and only read from the teleprompter.
