If two schools build a 30k and 40k stadium at the same price. There is no high maintenance in the seats alone.

I personally would rather be in the 40k stadium with a 30k demand. Maybe that's the Engineer in me but I feel like a design should always have scalability.

And jeez there is nothing worse than being stuffed into a crowed stadium next to some drunk 19 year old.

You seem to be looking at this from a fan's (buyer's) point of view and not the school's (seller's) point of view. Scarcity is what drives prices up, to the benefit of the seller. If there are always lots of empty seats, there are going to be a lot of fans who would have been willing to pay more for them - either in the form of ticket prices or donations/seat licences. But since they don't have to, they don't.
