Making it such a hassle for legal gun owners that they decide to give them up is de facto taking away the right.

Of course he would have, but he lost control of Congress and the SC justices didn't die fast enough for him to stack the bench. The next president could be nominating 3-4 justices over an 8 year presidency. That's why hillary is so dangerous to the second amendment
