You're right, man. I saw that and said, "No way an Assault charge, and 2nd degree at that, carry that kind of penalty." But it does.

I used to be a police officer here in WV and if that happened here, he'd have been charged with Battery(misdemeanor) or perhaps Malicious Wounding (felony).

That's the thing - he did! He left one bar, went to a food truck next to another and this guy followed him and continued to harass him and his girlfriend.

When a guy has harassed you, put his hands on you, put his hands on your girl, then follows you to another place two blocks away to continue to harass you, what the hell are you supposed to do?

Granted it's an anonymous redditor so not the most credible but the eye witness on Reddit says that's not what happened at all. If that guy's story is accurate he could even have a federal hate crime charge coming his way.

You leave that area period. Get a cab or whatever. Call the law if the dude keeps it up. Higbee's situation is different from you and me. He had millions riding on this. That's gone now and he could be looking at jail time and a civil suit to boot. Not worth the B.S. that came with it. He did "what a man" would do and he lost the biggest deal of his life and this will haunt him forever.

The people around him aren't getting his back and he's not looking innocent here. If it were me, I wouldn't even go out. I'd drink at the house. You're a target at that point. Wait til the draft and get your money.
