15 percent of latest Clinton emails marked classified
More than 15 percent of the latest batch of former Secretary of State Hillary Clinton’s emails released Saturday contain classified information, with three of the messages being labeled “secret” — continuing to add to the questions surrounding her email use.

One of the messages is an extensive missive from David Satterfield, a top U.S. diplomat to Egypt, who told top officials in both the White House and State Department about negotiations in the Sinai. The entire contents of the messages are now deemed “secret,” though there is no indication they were marked as such at the time. The message was forwarded to Mrs. Clinton by top aide Jacob Sullivan.

That would be an example of something that everyone, including Hillary, would know was classified whether marked or not.

I don't know if it matters at this point.

Bernie is gaining enough steam that Hillary might not get the nomination.

Best case scenario for the republican's is if Hillary wins the nomination and the email investigation continues unabated into the fall. A candidate that doesn't have enthusiasm and a scandal dogging them into the election cycle.

There is a lot of Independent men that won't vote for Hillary who would vote for a republican nominee. Men who don't care too much about Row vs. Wade or social issues.

Yet it was never marked as such. So perhaps you don't know that for sure?

With all due respect Paul, you have no qualifications to make this statement. Just as I have none to say that it should not have been classified. It's the duty of the originator according to the "experts" here.

And therein is the problem. Some people will excuse any lapse in judgement due to the slightest nuance, no matter how irreverent that nuance is. She should have known this was classified but beyond that according to her NDA it *does not matter if it was marked or not marked*.

And this is the person some want to put in charge of the entire executive branch.

I agree with most of this, although I don't know if Bernie will got the nomination.

As you indicated, the best case scenario for Republicans is that she is I so marred in controversy there is poor turnout. Dems are going to vote Dems and R's are going to vote R's. Its all about who shows up to vote. I don't even know if there is such a thing as Independent's anymore (or should I say a sizable number of them).

Title is misleading. These emails weren't marked as classified. They may have contained classified information but that doesn't mean they were marked as classified.

It's the articles title, not mine.

Once again, for the slow folks, Hillary's NDA contained the following phrase from SF-312

Quote:As used in the SF 312, the SF 189, and the SF 189-A, "classified information" is marked or unmarked classified information, including oral communications and unclassified information that meets the standards for classification and is in the process of a classification determination, as provided in Section 1.1© and 1.2(e) of Executive Order 12356 or any other or Executive order that requires interim protection for certain information while a classification determination is pending. "Classified information" does not include unclassified information that may be subject to possible classification at some future date, but is not currently in the process of a classification determination.

http://freebeacon.com/wp-content/uploads...d-NDA1.pdf

She violated her NDA, in plain English that's what happened. Now the only way out of it is if our secretary of state, the smartest woman alive, cops to being ignorant of obviously confidential information despite being briefed at length on what is and is not classified.

Quote:A party to the SF 312, SF 189, or SF 189-A may be liable for disclosing "classified information" only if he or she knows or reasonably should know that: (i) the marked or unmarked information is classified, or meets the standards for classification and is in the process of a classification determination; and (ii) his or her action will result, or reasonably could result in the unauthorized disclosure of that information.

When I worked for the army I had to sign an NDA (1998 for forgive me if I don't remember the exact form number that USACE used at the time, it might have been 189)

I was also briefed in on what was and was not privileged information at the highest level to which I had access. I was expected to know what was and was not privileged and when in doubt *err on the side of caution*.
