I've mentioned this compromise already but it doesn't appear unfortunately that the two parties would work together on this at all. Instead we're likely seeing a stalemate.

I'd be disappointed if it's Lynch. To me, that's purely political and Lynch didn't exactly have an easy passage through to be confirmed as Attorney General.

My compromise is Obama approaches Ginsberg about retiring. Lynch could replace her (and she's not the ultra-liberal that Ginsberg is). Put up a moderate of sorts to replace Scalia and tell McConnell that while the court would be moving some to the left, it's not as bad as it could be. The Republicans save face and even if the court moves a bit to the left, they can get it back to the center if they win in November - Stephen Breyer is a likely retiree under the next President (and Kennedy too).

None of this will happen but I think Obama is a better man for doing something like this than putting up some scapegoat whose nomination won't be heard and whose nomination is out there just to rile up a particular voting block.

How about an actual constructive idea. Obama sits down with Mitch McConnell and they negotiate a candidate acceptable to both sides.

There has to be a least one qualified candidate who is a true centrist and not a right or left wing ideologue. (If there isn't, then we have a much bigger problem in this country than anyone can possibly appreciate.)

If Ginsberg retires, that'd put the Court at 7, and I'd think that would be the "compromise" for now.

FOX News says that Obama will probably announce a nominee for the slot next week, so I'll give him props for not doing a recess appointment.

One thing I heard that I didn't know... is that if there's the possibility of a 4-4 split in the court decisions, Roberts can simply say, we're not going to cast a vote on this issue until the Court is back to a full compliment of judges in the next session. It basically lets lower court rulings stand for one year, at which point it goes through the whole process all over again at the next SC session. (oral arguments, redebates, etc.)
