An arrest was a bit much. She should just be reassigned. This whole thing is silly.

Heat? Pfft.
He likely saw a hugely expensive sideshow forming in the community...kids missing school today for one...and realized this was only making the scofflaw bigger than she needs to be.

You call it a sideshow, others call it bringing the heat.
He injected himself into a process that has a remedy. He did not follow standard procedures for jailing for contempt. And now there is a large public outcry.
He also didnt want to be publicly admonished by an appeals court for jailing for contempt improperly.
That is called bending to the heat.

I'm not digging into the specifics, but as an elected position (D, incidentally) how could she be reassigned? By whom? To where?

Maybe if the other Democrats in Morehead (Rowan County Fiscal Court) or Frankfort (the legislature) would impeach her, then it could be resolved. She can not be explicitly reassigned, although there's nothing stopping her from working as a deputy for the next county clerk, or as the circuit clerk, or even the county Judge/Executive (Kentucky's weird title for a county's chief executive).

No elected official wants to go near this. The Kentucky law that passed barring same sex marriage had 75% support. She wouldnt be impeached.

I imagine that in Kentucky, like here, there are a lot of things that can be done. A clerk may be elected but they work for the presiding Circuit Judge.
But, who knows; it's Kentucky.

What was the remedy? She knows she must not interfere with the deputies that will approve these marriages, something she did not agree to prior to her jailing, and she couldn't be removed without a meeting of the legislature.
And you need to get out of your echo chamber if you think there was a 'large public outcry' over the judges actions.

This has been listed a dozen times in this thread. She's an elected official. The remedy is for the people to vote her out, or for the state legislature to impeach her. 2 remedies, and neither were attempted.

You do realize they shut down three schools today due to the crowds they were expecting? We arent just talking about the hundreds that showed up over the labor day weekend.
Funny how no politician wanted to touch this one, and the judge who ordered her jailed for a week suddenly cracked.

Two things going on...
1 - Judges do not like to be defied so even f Jail was silly it was an exclamation point on his authority.
2 - While were tripping over ourselves to take words like husband and wife off of marriage certificates we should be able to remove office holders name and place just the name of the office. But long ago we moved from "Tolerance to Acceptance" and now the push is "Celebration".

1. There have been 10, now 11, posts on this thread, so you can stop with the hyperbole about how many times this has been repeated because it most certainly has not been a dozen times.
2. You cannot simply vote her out or impeach her without taking a long period of time, time in which citizens are being denied their rights and which opens the county to serious lawsuits, lawsuits which costs large amounts of money. This entire situation was caused by a lawsuit in the first place, a lawsuit which cost the government lots of money and which ruled in favor of those wanting to get their marriage licenses. That led to a court order, the order she refused to follow. The remedy for someone who refuses to follow a court order, otherwise known as contempt of court, is jail. I don't know how to explain this to you, but this was the remedy for this situation, and this is how these situations work.

The judge didn't crack, a solution was found that she agreed not to interfere with the issuing of marriage licenses and her deputies would do it instead, something she had not agreed to before. As for the shutting down of three schools? Again, if you think that is evidence of 'large support', you need to get out of your own little echo chamber. And btw, no LOCAL politician wants to go near this. Thinking that applies nationally is indicative of republican issues at the national stage.
