marijuana...this will be interesting...tony stewart/kevin ward civil suit...
espn - tony stewart civil suit

Quote:Kevin Ward Jr. was killed Aug. 9, 2014, in an Empire Super Sprints race at Canandaigua (N.Y.) Motorsports Park when, after crashing, he approached the other cars on foot as they were riding around under caution. Stewart's car struck Ward, who was pronounced dead at a hospital 45 minutes later.

Stewart was not indicted by a grand jury, and Ontario County (N.Y.) District Attorney Michael Tantillo said Ward had enough marijuana in his system to influence his actions. According to Stewart's response, Ward's toxicology report indicates that Ward used marijuana within five hours of the event.

I can't find anything that shows where this statement can be true.

this is the best my 5 mins playing with google came up with

police regulating driving under the influence of maryjane

another one from 2014

Quote:Even though a person tests under the threshold, however, does not mean he cannot be charged with driving under the influence. In some states, a prosecutor can present evidence of the driver’s behavior or other extraneous proof (such as a smell of marijuana coming from the vehicle) to prove impairment.

we already knew this one....but the following has huge implications of relative to what laws could be developed.....and knowing how stupid the system is.....well, this one make ME nervous....

Ward may have gotten stoned to the bejesus a few days, and day, that morning, or right before the race....if someone has a linky to something concrete that defines how 5 hrs can be definitively defined, I'd love to read it....

this case should be a concern for pro marijuana advocates....

this is not about whether it should be legal....this is about testing and how it will be administered by laws moving forward....to the best of my knowledge, there is no way to clinically define a 'time frame'...

I'm all ears if anyone is interested.....my thought was if I queried "measuring marijuana weed driving testing" would cover it....and I tried a number of derivatives....
