Someone received those emails. A record of them probably still exists somewhere.

Supposedly that server was backed up to another before it was wiped.

Even a supposedly "clean" server can have stories to tell. It depends on how it was set up, if it was backed up etc. They should at least be able to tell when the "cleaning" happened. If she cleaned it before a request was made for it's contents she has plausible deniability. If the timing of the "cleaning" coincides with a request for the server contents, her troubles get worse.

Remember it wasn't the crime it was the cover up that did Nixon in. A cleaned personal server may in the end be just as damning as the erased tape.
