There are those who apply the constitution to decisions (the Four dissenting) and those who redefine the constitution to fit their decision (the Five in favor).

RE: Scalia Dissent
It's funny (or sad) that Scalia's opinions are legal genius and the other side can only counter with: "Ignore the law, gay marriage & Obamacare are more fair than what we had before".

RE: Scalia Dissent
Scalia is mad as ****. His dissent is ridiculous, hardly even explains what his legal reasoning. It's like he's an internet troll.

And he's a joke now. He writes a decision saying the government can invoke the interstate commerce clause to arrest you for growing pot in your house for your own consumption, yet the interstate commerce clause is too narrow to cover ******* NATIONWIDE HEALTHCARE.

His butthurtedness has all been too hilarious. He's said repeatedly in other opinions that a passage can't be yanked out of the statute out of context and must be taken in consideration with the whole, and that the court must try to follow the will of the legislature. The dissent's tortured reading is very obviously not the will of the congress. And the word "state" is often used to refer to government at all levels, not just the US states (and commonwealths). And today was priceless. Equal protection and substantive due process are as applicable here to gay marriage as they were to interracial marriage in Loving v Virginia, and in 20 years people will look back on the opponents of gay marriage just as they did George Wallace and the Loving opponents.

Hey genius, interstate commerce only affects commerce ACROSS STATE LINES. Last time I checked, OBlundershit forbid commerce across state lines.

Get it now?

Google Wickard v Filburn genius. Growing wheat in your backyard for your own consumption has been considered interstate commerce for the last 80 years, so concluding that Obamacare somehow isn't is ******* ludicrous. I don't know what "OBlundershit forbid commerce across state lines" means, and it doesn't.

I remember the hooplah over the Ginsburg dissent in the Bush v Gore case, when Ginsberg said "I dissent" instead of the usual "I respectfully dissent." The supreme court reporters were like "oh wow, thats huge. They never do that." If that was the extent of a radical dissent, then I think some people shat their pants today, cause Scalia basically went thermo-nuclear.

yeah thats what i thought...like in 100 years they will be reading it and still saying....dammit man

Scholars in future centuries will wonder why they didn't listen to Scalia.
This country won't make it that far

Sad but true

This is great...

Any country that can't see that there is a difference between "man-woman" and "man-man" doesn't deserve to survive.
