There are blatant abuses of the program that need to be stopped. I won't deny that. By and large the H1B program is still very much needed.

H1B individuals, like the undocumented Mexican migrants, do jobs Americans are unwilling and unable to do. When getting an MBA or going into wealth management or accounting is just as lucrative as getting a PhD in Immunology or Materials Engineering while requiring fewer and less rigorous years of education, it's no surprise we have needed foreigners to pick up the slack in these areas.

Want to know why the STEM unemployment numbers H1B critics point to are as bad as they are? Because people with certificates in high-level programming languages and degrees in nutrition science and ecology are counted the same as people with graduate degrees in mechanical engineering or solid-state physics.

H1B complaints are the "they turk urr gerbs" of liberal middle class white people. They'll call people xenophobes if they complain about undocumented migrants driving down wages in low-skill jobs, but bring in foreigners with their level of education and they start singing a different tune.

While there are lots of Tech Job openings, it is 100% wrong to displace existing workers with H1-B visa workers. In the technology space companies have found offshoring development work does not work well, SO, they opt to use H1-B visa workers as developers and say these workers are "flex staffing". There are now contract companies that specialize in provide H1-B visa tech contractors these contractors do the same worker as contractors that are US citizens for about 60% of the cost. This is another abuse of H1-B visas.

If Disney, or any company were to allow their laid of employees to return as contractors the former employees could sue to be reinstated as an employee. Most companies have a 6 month separate period to protect them from these kinds of lawsuits.

Another example how manipulating a few words (blacklisted) can make a common business practice, required to adhere to labor law, sound like something sinister.

Overall, the H1-B program is an example of a well meant law being abused.

One change I'd propose is that any foreign student who receives a masters or PhD in a STEM field, be offered a Green Card upon graduation. Why should we educate these kids only to see them go home and start companies which will compete with US companies. (Of course I could channel Adam Smith as to why a stronger global economy works for our benefit, but today I'm wearing my protectionist hat.)

There are a few problems with the H-1B program.

Firstly there's an extra 20,000 spots (over 65,000) for those who are getting advanced degrees in the U.S., but since USCIS stops accepting applications after the first few days in April, most students who are in a graduate program don't have the degree yet, so they fall in the 65,000 quota.

Secondly, the visa allows you to start working in October and the applications come in from April, as I said above they get exhausted after a few days. If you're looking to employ a foreigner for some position that you can't find an American for, you probably have to start your job search in January at the very earliest, have a candidate by early March so that you can file the application by April 1st. That means you can't actually have them working for 9 or 10 months, even if they get accepted, and since there are almost three times as many applications as there are visas, that isn't a guarantee. How can a business do that wait 9 or 10 months for an applicant who might not even get a visa? It's barely worth them searching. However, these outsourcing IT companies aren't filling specific positions, so they can just have 15,000 applicants and they employ the 5,000 that are successful, they don't care about that 9 month gap, because the new guys will be replacing the people whose visas run out in October.

There are programs for students in the U.S. that help, you can work as part of your degree 'training' in a job related to your major for 12 months, or up to 27 if you're STEM. Again, the problem is trying to convince a company that this is worth it, they have to get immigration lawyers involved because they don't have a clue. The 27 months allows your to work through 2 or maybe 3 H-1B cycles.

Getting an H-1B is really hard work for most companies, as it should be. However it is much easier if your business MO is based around hiring H-1Bs and it means that applications have shot through the roof for these outsourcers who are harming American employees and harming American businesses who may need to hire a foreigner but are drowned out by the sheer numbers that they're competing against. It's a complete abuse.
