This is far from the first time Obama and/or his people have done this... and I'm confident they aren't the first... but it really needs to stop. By speaking like this about the courts... Obama is undermining faith in our judicial system by implying that he and his cabinet literally know more about the law than the judges. I'm not saying he has to agree with it... I'm merely saying he needs to instruct his spokespeople to be more respectful of out system of checks and balances.
Justice Smith Graduated from Yale Law and the other two from Harvard... They have all been involved in the court systems for a very long time. He certainly may have, but I'm unaware that Obama clerked for any substantial judges or ever actually practiced law or argued a case....
The issue at hand is not the legality of Obama's position on immigration, which is an entirely different issue... but that to issue a stay would require that states issue all sorts of licenses to people, granting them rights they don't currently enjoy under the law that ultimately may have to be somehow rescinded, should the 26 states against his law prevail... causing potential harm to the state.
While I certainly understand that Obama and his people disagree on the underlying immigration issue... It seems ludicrous for them to argue that being forced to issue all sorts of licenses and deliver benefits that MIGHT have to then later somehow be rescinded isn't in any way damaging to the 26 states (especially Texas where you're talking about 500,000 people)... or that these appellate judges don't know as much about the laws regarding stays as someone who has never practiced appellate law.
Work diligently to undermine the very institutions that made America great.
Our independent judiciary and that system, with ALL the rights and privileges it contains, is anathema to our "constitutional scholar" just look at his pathetic record in the courts.
He's the Chitcago Cubs of presidents. Maybe worse.

This alludes to what I said. Rather than fight to force states to let it happen until the court decides on whether or not it is legal, they will push to have the court decide whether or not it is legal.
To me, it's not about whether or not the administration agrees with the states or the courts... of course, not everyone will EVER agree on much... but about whether or not it respects the states and the courts when they disagree. They had a petulant and rather childish response and now it seems cooler, more mature heads are prevailing. Since he didn't do it, I can't blame Obama for the childish response... It's just not a good reflection on him since it came from his spokesman.

It would be funny if someone files an amicus brief to the court where they list Obama's own words saying he didnt have authority to do this.
