An Andy Rooney Moment
1. Have you ever wondered why anyone would want Texas in their conference, or for that matter North Carolina or Duke? Why do you want to take three schools all of which are much more selfish, a tad more arrogant, and much harder to work with than say Alabama, or Michigan, or Stanford. What would getting them mean? In the case of Duke it might mean getting to beat somebody fairly regularly in football although they are far from the pushover they once were a few years ago. Beating the Tar Heels in football might be satisfying but it's also risky. Nobody really expects Carolina to be great but they are usually good enough to ruin somebody's day at least once or twice a season. And Texas, I mean if you beat them they blame it on the coach instead of an inferior team and if you lose they are the kings of the world. No wonder Aggie hates them. Maybe we should consider what a 60 school upper tier would be like without Duke, North Carolina, Texas and Notre Dame who I only included because they want to be independent. But in fairness the Irish are way more acceptable than the other three and they probably deserve a better fate. I tell you what just substitute Virginia for Notre Dame and call it a done deal. They don't really want to play real sports at UVa anyway.

2. And what about GOR's? I'm not so sure they are even legal for state schools to enter into. Think about it. The state schools are funded by their legislatures. What they earn can easily affect those appropriations decisions. Who really has the right to sell their media rights, the presidents of the schools, or the states that fund them? And that brings a bigger question into focus. Everyone accepts that musicians and performers have a right to enter into a Grant of Rights when they are signed to contracts with big time producers and recording studios and the like. I'll even say that private schools probably have that right as well. But do state schools really have the authority to sell their earning potential when that revenue and the rights to it should really be the purview of the state that funds them and the representatives of the taxpayers who fund them? I think this is a fundamental question. Look at the victory that Oklahoma and Georgia had over the NCAA's perceived right to broker their contracts. Does an entity such as a conference even have the right to require it's state school members to sign such a contract absent the approval of their governments? Is the conference really any more of a legal entity than the NCAA? I'm not sure the courts would think so. Clearly state schools are the property and an extension of the state governments. Private schools are not.

I have a sneaking suspicion that the states might be able to override the GOR and that conferences while beneficial may not have the right legally to supersede the governments who might like to move those schools where the revenue generated could positively affect the appropriations process. I think it would be an interesting challenge.

3. Now what about realignment in general. What would happen if states took control of their universities' sports teams. Would we even need conferences? States themselves might be able to decide what collection of like minded neighbors would constitute their alliance. It could rock the collegiate sports world if such a challenge was ever mounted. Why wouldn't states want to maximize revenue by realigning themselves and their schools?

So, I'm not sure that everything that has been done has been done in a fashion that is lasting in any kind of legal and binding way. Sleep on that!
