Catching up on threads here.
I bet this gets overturned a bit on appeal. Judge got a little power hungry. They conduct was awful, but it isn't racketeering. Once again, we have an overcrimalization (is that a word?) of misconduct. It was a disciplinary matter, not criminal. Although the weird thing is after you serve a whole sentence for racketeering, your record is esponged. So technically, they could get hired again.

How do you figure? They were conspiring to defraud the schools/county/ State of tens of thousands of dollars. They did it with intent and premeditation, they knew exactly what they were doing and took that money from someone else actually deserving. Not to even mention the kids they cheated.

The only person who ever got any real cash of significance was the Superintendent. Other administrators were going to be promoted up the chain for following orders on high. The problem is that their really wasn't a great law to prosecute the teachers' transgressions under. RICO would have been fine for the perps at the top, but those teachers should have just had their licenses revoked.

agreed and like I said, if they go to jail for RICO and fulfill their sentence, they come out with records esponged. They could go and do it again.

Penalty seems HARSH. Seven years? That being said , what the hell is with these teachers not pleading out? Of coarse they are guilty and could not win in court. Did they not listen to their lawyers? Did they not listen to the judge when he suggested to work something out before sentencing? Still -7- years is a stiff penalty.

Actually it was 20 years. 7 in GDC and 13 on Probation. Georgia can do Hybrid Sentencing.

IMO, way too harsh a penalty. I think those that didn't work something out prior to sentencing were fools.
Funny, but when you hear about how those in government mis-spend money on junkets and lavish conferences, the dollars we're talking here a miniscule compared to government waste.
I guess it's okay for the powerful in government - just not the low life peons.

This is why I believe in cruel and unusual punishment as an option instead of a lengthy sentence.
Convicts should have the option to dig holes, build fences, harvest crops etc in exchange to decrease the length of time behind bars.
The tax payers wins in all sorts of ways with this option.
