Man, folks really weren't kidding when they said it'd probably take an indictment to get some people talking.

It's disturbing that a public institution can sign people to agreements like that.

"The severance agreement also includes a length "confidentiality" clause, which outlines all manner of "Confidential Information" and states that Mackin agrees "to treat all Confidential Information as strictly confidential" and "not to directly or indirectly disclose, publish, communicate or make available Confidential Information."

The confidentiality clause is so detailed, it requires that Mackin not disclose the terms or even the existence of the severance agreement itself to anyone other than his wife, his attorneys and his accountant or in response to a court order or subpoena.

The agreement mandates that Mackin's wife, attorneys and accountant also "treat the Confidential Information as confidential."

I've said all along that Mackin must have an NDA with teeth like a Great White. We don't know the details as far as the financial penalties, but just the structure gives you an idea of why he has said nothing.

To have that level of a nda just shows the level of corruption behind the decision & he probably knew what was in the works & based on his reply of "needing to make that homerun hire" for fb coach. He might've misjudged thinking that the hire could forego that decision whereas it really wouldn't have mattered in any case

So it's not the money that keeps Mackin quiet but the NDA he had to sign for himself and his family and accountants.

Given the way PBJ operates, I wouldn't be surprised if there was some other forms of intimidation going on to get Mackin to agree to the deal.

Personally, I can't believe that a public institution funded in part or whole by tax dollars is allowed to secure NDAs.

It is amazing to me that this should be allowed from a legal standpoint. I would think this sort of behavior could/should be stamped out through legislation. Corruption and closed-door deals are some of the biggest factors holding back not just UAB but this entire state.

I think Brian Mackin is an honorable guy who got a raw deal. In today's world, that severance package is a slap in the face.

I know everyone doesn't feel that way, but I do. He could still be drawing the same salary he was and "going along to get along," but his heart wouldn't let him. I admire that.
