Non compete clause
Reviewing the wording on the non compete clause of the Fed Ex Forum agreement with the grizzlies. The way it is written it may prohibit the U of M from building an OCS of less than 50,000 seats. The question would be what constitutes "covered"

I would think that the university can build any size arena/stadium it wants and the non compete clause only pertains to the city and county

It is the part about the city or county having any part with planning or giving assistance or tax reliefs or incentives, City and county would not be able to help in the infrastructure in any way. No tax incentives, to help getting assistance from the state. No sewage or electrical work. City wouldn't even be able to cut road access or traffic control signals. It seems to say city and county would have to completely hands off and they are not allowed to do anything that could be considered helping.

Looks like it only applies to indoor or covered facilities. An open-air stadium would not be an issue.

No clue. I was wondering that myself, but I didn't think it was applicable for an OCS, so I didn't wonder too long.

This does not apply to any building construction contracted by our university on university/state property. Hoops, the city and the county have no standing to restrict the university relative to OC facilities covered, uncovered or otherwise of any size. Since the university, as a state institution, is exempt from city & county taxes, there are no such incentives that the city could provide which they might otherwise provide to a private endeavor but be restricted by that contract language. Further, the city and county are routinely involved in providing infrastructure related to roads, utilities & the planning of such, that too is not prohibited related to anything the university might do relative to OC facilities.

even if they could (doubtful reading the language) that's a far cry from actually forbidding it. The Grizz aren't crazy/stupid enough to say no if it ever was an option. The uproar and outcry would be a PR nightmare, that many outside media would pick up and run with.

Without permission

But technically, providing infrastructure could officially be for a different reason. The funding mechanism could be through the state (i.e. Sales tax rebate on items within a certain radius).

BTW... Hoops LP is no longer a thing.
