I think that there's a couple of principles at work here.

1) There's a difference between 'not disclosing' and 'lying about status'.
2) People are responsible for protecting themselves by wearing condoms.
3) There's a difference between exposure in the course of consensual sex and exposure in the course of non-consensual sex.

The case of a person who doesn't disclose because he isn't asked is different from a case of a person who lies about status or who doesn't exposes persons in the course of another crime.

I'm not sure you can go with a hard and fast rule here. That's the problem. Number 3 is easy. Lying is hard to prove. I'm leaning towards 'caveat emptor' in the case of non-disclosure in the face of someone not asking.

Making someone liable for inadverently passing on a disease is fraught with all kinds of issues. What's next? Suing someone because they gave you a cold at the office? Or suing someone for flying while contagious on a plane? Why limit it to passing on sickness in a sexual context?

No one dies from a cold.

That said, I find this to be an actually reasonable, and perhaps *gasp* productive thread for the spin room. Might be the first one ever, since I've been here.

Nothing says I love you like taking a dick up the ass. Pardon me for not being PC but the whole culture is sick. I say that I don't really care what two queers do in the privacy of their own homes but on certain levels I do care.
