I'm saying that what happened is is not necessarily plagiarism, and most likely is not plagiarism.

Two points:

1) Plagiarism is unpermitted use. These guys play on the same team. The fact that two people with similar views express their views on a specific issue in similar language does not indicate plagiarism. For all we know, they may both be taking their language from some third position point memo. But if Amash or his staff came up with it and the other guy used it, that's probably fine with Amash. That's what I meant by no lawsuit for want of a plaintiff. I don't have standing to allege any violation, neither do you. Amash does, but he's not going to. No plaintiff, no problem.

2) That lawsuit would be for copyright infringement, not plagiarism. Copyright infringement is a legal issue, but plagiarism per se is not a legal concept. It is primarily an ethical concept in academia or business, and this isn't academia or business.

So the master's thesis is plagiarism but this isn't, because the contexts are different and because there is no indication of permission in the master's thesis.

I disagree. plagiarism isn't unpermitted use, it's passing someone else's ideas as your own whether by permitting or not.

Plagiarism is largely an academia concept, and this isn't academia. The comparable real world equivalent is copyright infringement, and permission is always a defense. The other factor is that the quotes deal largely with positions on issues, and guess what, if you and have the same position on an issue, our statements regarding such issues are going to sound a lot alike.

Yes, word for word, or nearly so. How else would you do it? There are only so many ways to express a very specific point. And these were not exactly word for word.

And again, plagiarism is an academic concept. You're not going to sue somebody for "plagiarism" in the real world. You sue for copyright infringement. And consent is a defense. And the only one with standing to sue would be Amash. And he's not suing.

You are trying to impose a standard that does not apply.
