8-Team National Playoff: NonBCS schools must organize & threaten monopoly lawsuit
It is most likely that the 4-team national playoff will be expanded to 8 teams. The Five NonBCS conferences must now organize themselves under one national umbrella and threaten a monopoly lawsuit when the move to 8-team playoff is made. NonBCS conferences must be ready to position themselves into an equitable (forget equal) position with BCS. Two strategies should be followed.

First, threaten a monopoly AND CIVIL RIGHTS lawsuit against BCS. The argument should be made that the BCS schools were able to grow and prosper because they did not have to face the unfair and monopolistic rules of exclusion which the BCS now exerts on NonBCS schools. That's the monopoly part of the lawsuit.

Second, a civil rights petition should also be made. All schools, BCS and NonBCS, make the argument that the athletic program is part of the total educational experience for athletes and nonathletes alike. Well, by its exclusionary practices, the BCS is violating NonBCS students' civil rights to enjoy the full breadth of collegiate completion such as basketball, golf, tennis, track, etc. In addition, the civil rights exclusion of NonBCS schools creates a public impression that the educational programs of NonBCS schools is inferior, just as BCS implies that the NonBCS athletic programs and teams are inferior. It is like the days of discrimination, one drinking fountain for whites and another drinking fountain for African-Americans.

The two episodes at the Denver Airport with MWC and the Times Square Banner episode with AAC were a total waste of time and energy and, most of all, automatically forfeited the opportunity for the NonBCS conferences and teams to advance their cause under a united and coordinated effort. The foolishness of these two episodes must not be repeated again.

Dude...everyone agreed to the current structure...and the way it is worded the Playoff is not "Conference Centric" it is School Focus...everyone in FBS is eligible for the playoffs...Conference Champions are not guaranteed access, you have NO AUTOMATIC BID to the 4 School Playoffs...it is done by a committee...07-coffee3

Could you please explain what the problem was with the new AAC teams getting banners in Times Square?

Tallgrass you have made some unusual posts in the past, (and some very good ones as I have told you....see PM's) but this one is off the wall.

Me thinks you were in Washington D.C. toooooooooo long.

RE: 8-Team National Playoff: NonBCS schools must organize & threaten monopoly law...
"Judge Burciaga then examined the conduct of the NCAA under both the per se rule and the rule of reason. Finding that the NCAA violated antitrust laws under both evaluations, Burciaga issued both a declaratory judgment and a permanent injunction prohibiting the NCAA from interfering with the individual university contracts and declaring the NCAA-ABC contract null and void."

LINK: NCAA v. BOARD OF REGENTS OF THE UNIVERSITY OF OKLAHOMA

BCS rules are exclusionary and therefore monopolistic. BCS is now doing what the judge said NCAA could not do....act as a monopoly.

"In this(BCS) selection process, the BCS is often criticized for conference favoritism, its inequality of access for teams in non-Automatic Qualifying (non-AQ) Conferences (most likely due to strength of schedule), and PERCEIVED MONOPOLISTIC, PROFIT CENTERED MOTIVES."

LINK: BCS CONTROVERSIES

The BCS has been very clever to avoid the charge of monopoly. The BCS selection process is only for the 4-team National Playoff. Since a NonBCS team is highly unlikely to be ranked in the top 4, no charge can be brought that the BCS is exclusionary.

Selection of teams to the BCS bowls is now up to the individual bowls. So now the bowls, and not BCS conferences, become the tool of exclusion. And BCS conferences can claim it is not their fault that NonBCS schools are not selected by the Orange, Sugar, Fiesta, and Rose Bowls....in fact BCS can claim they FORCED those bowls to take at least one NonBCS team. Very clever on BCS's part....

I think the G5 have to band together and have a unified organizational structure. If they don't hang together, they will surely hang seperately. However, expensive lawsuits just send money to the lawyers.

Here is what a "United G5 Superconference" could do:

  1. Jointly negotiate TV rights (definately Tier 1 & game of the week, probably tier 2 national broadcasts)
  2. Arrange post-season play (match top teams not in BCS in bowls: 1 vs 2, 3 vs 4, run a 16-team FCS-type playoff for the rest so every eligible team makes the post-season)
  3. Force teams out that never should have moved to FBS (Idaho, UMass)
  4. Realign olympic sports to regional conferences to reduce travel costs
  5. Keep conferences from inviting teams to FBS that aren't ready (Buffalo)

In this way, the G5 can maximize their clout and their money. Sacrifice some autonomy, but gain a whole lot more.

1. You used Wikipedia as a source/link.

2. The BCS doesn't exist anymore...everything now in regard to Bowls is purely Tie Ins...the Rose Bowl tie in is with the B1G & Pac 12...Sugar Bowl with the SEC/Big XII And the Orange Bowl with the ACC/SEC/B1G/Notre Dame...no different from any other Bowl...07-coffee3

To me, the significance of this USA Today article is not what BCS has done...but how BCS has gone about it. BCS is organized under one organizational unit speaking with one voice....and they have their voting procedure and rules in place. All very nice...if your are BCS. The NonBCS conferences have no organizational equivalent to punch back.

Actually not every one agreed to it. Further, most of the rules being changed now are being forced upon many schools by the few with power. So even though his rant is out there, it's justified. The point is, the schools not represented by the P5 monicure and or ND should band together and fight for equality.

Having 3 representatives for the P5 and only 1 representative for the rest isn't fair. It's unequal and exclusionary in nature. 07-coffee3

Point being at the end of the day the G5 agreed because for the most part outside of the Old BIG EAST they received a HUGE Pay Raise....07-coffee3

No, they signed because they were under the missinformation that they would be included in the upper echelon, which doesn't appear to be the case. Now to add insult to the wounds, the P5 are pushing for even more power.

That's what happens when you lay with the devil. You get burned. 07-coffee3

So....you're going to force the Rose Bowl to kick out the PAC and make them take the MWC champ instead?

Good luck with that

Actually, if they wish to be in the rotation for the College Championship Playoffs, then they will. If they don't, then the won't. 07-coffee3

I'm sure the Rose Bowl is quaking in its boots that the G5 is going to force them to break a signed contract and sign a new one they don't want just to accomodate the mighty and valuable G5!

You're funny. I would point out to you that this is a message board and that no one posting here knows exactly what's going to happen but, I'm sure you'll point out that you know everything. 04-cheers

My point is, If the rules are made so that a team other then what's currently in the so called P5 has won the right to play in the "Rose Bowl" then they have no right of refusal under the contract they will sign to host the Playoffs. Please feel free to enlighten me as to how the Rose Bowl will deviate from their own contract just to keep the "History" between the Pac and the B1G alive. 07-coffee3

You clearly don't understand how this system works.

When the RB hosts the semi final or championship game it can be anyone because it's the playoff and not the Rose Bowl. But when it's the actual Rose Bowl Game the other years there will never be a G5 team in it or anyone but the B1G and PAC teams.
