He can try and good luck. He signed a no drug use policy. His employer has requested he take a drug test. If he passes, he keeps his job, otherwise he's gone. Using drugs is no different than being ungroomed or smelly. You may have a legal right to use the drugs, but the employer does not have to disparage their image or open themselves up to liability.

I don't see the problem.

When I was in college and smoked all the time I just got a job at Apple, got my stuff from my manager.

I rode my bike through downtown Spokane last week. I was surprised that I only passed one biker who smelled like weed.

I think he understands he's a burnout, and the article didn't say anything about him arguing it.

Pot may just be the drug that thins the herd. Keep the morons incapacitated while the smart people make the money.

A lawsuit can be filed, but it won't be successful. You can be fired for lots of legal things. I used to work for a company that announced that if they found an employee riding a motorcycle without a helmet, that it was grounds for termination.

I used to work for companies that had strange rules like that. They said if you're too stupid to ".........." then you're too stupid to work here. But hey, they told you up front what not to do if you wanted to work there.

Yep, as long as it is in the employee hand book before they fired him and he signed a paper stating he read it and agreed to the terms, he's done.

I smoked in college for a few years, it was fun, but I grew up. But, if I win enough on scratch off, I'm moving to Co or Wash. And opening a store, they are making a killing out there.
