Texas AG Abbott Considers Suing Feds Over Illegal Alien Children

Quote: Texas Attorney General Greg Abbott on Thursday said he is considering a lawsuit against the federal government over the costs associated with housing thousands of immigrant children detained on the U.S.-Mexico border.

“The State of Texas is exploring any and all options, including litigation, to address the crisis our federal government has created by not living up to their Constitutional responsibility,” Attorney General spokesman Jerry Strickland said. “If the federal government is unwilling to secure the border, the State of Texas will be forced to resort to litigation to recoup the costs incurred to respond to this crisis.”

Thousands of unaccompanied minors have crossed the nation’s southern border this year, many fleeing violence and poverty in Central America, overwhelming federal facilities to house them as they await immigration hearings.

State leaders last month authorized the Texas Department of Public Safety to spend an $1.3 million to combat crime and human trafficking along the border.

Abbott’s comments about suing the federal government came the same day Gov. Rick Perry appeared before a congressional panel in McAllen to discuss the issue. Perry reiterated his call for Congress to recoup the $500 million he says the state of Texas has spent on border security since 2005. He also asked the feds for an increase in the number of Texas National Guard units in the area and comprehensive health screenings for any detained immigrant child released into Texas communities to await court dates.

It would not be the first time Texas has filed a suit against the federal government over the state’s border enforcement costs. In 1994, Attorney General Dan Morales sued to recoup $5 billion for services provided illegal immigrants living in Texas. The suit failed in the 5th U.S. Circuit Court of Appeals, where the presiding judge expressed sympathy with state officials while urging them to take the issue directly to Congress.

The vast majority of 50,000 unaccompanied youths and children who have illegally crossed the Texas border during the last few months have been successfully delivered by federal agencies to their relatives living in the United States, according to a New York Times article.

A second New York Times article report revealed that officials have caught an additional 240,000 Central American migrants since April, and are transporting many of them to their destinations throughout the United States.

The 290,000 illegals — so far — are exploiting legal loopholes that allow them to get temporary permits to stay in the United States.

Experts say that President Barack Obama’s administration has failed to close the loopholes and is unlikely to deport more than a small percentage of the illegals, despite the high unemployment rates among American Latino, African-American and white youths, and the strapped budgets of many cities and towns.

The president’s policy has caused protests by frightened citizens in towns such as Murrieta. But Obama’s allies — such as La Raza, an ethnic lobby for Latinos — are eager to escalate the conflict and to paint the protestors as racists. Those protests may escalate before the November elections.

The Central American parents of the 50,000 youths and children are using a 2008 law to ensure their children are transported to them for free by a relay of border patrol and Department of Health and Human Services officials. The youths are delivered to the border patrol by smugglers, dubbed coyotes, in exchange for several thousand dollars.

Half of the 50,000 Central American youths were delivered by taxpayer-funded employees directly to their parents now living in the United States, and another third were delivered to people who said they were close relatives, said the July 3 article.

That new data was included in the 19th paragraph of a 20-paragraph July 3 article.

Top immigration officials choose to not check if the relatives or parents who pick up the children are in the country legally.

Both New York Times articles described the border-crossing illegal aliens as “immigrants.” In fact, “immigrants” is the term for people who legally migrate into the United States.

The 240,000 strong-group largely consists of many mothers and young children, most of whom are now being flown and bussed to destinations near where they wish to settle. That new 240,000 number was included in the seventh paragraph of a 24-paragraph article.

Few of the illegal immigrants are high-school graduates, or have skills that would allow them to earn more than they cost to federal, state and local taxpayers.


Officials have not said where they’ve delivered the adults or youth illegals, but pro-American activists are keeping track of some locations, including San Diego, Calif.

Officials have defended the administration’s catch-and-release policy, which critics say is inviting more Central Americans to cross the border in the hope of being arrested by the border patrol.

“When you have a noncriminal [border-crossing ] mother, they are going to be released,” David Jennings, the head of the Immigrations and Customs Enforcement agency in southern California. “The most humane way to deal with this is to find out where they are going and get them there,” he said at a town meeting held in Murrieta, Calif., according to the New York Times.

The border patrol is now refusing to give details about the whereabouts of the buses or future movements. “Due to security considerations, we are not providing any further information regarding the schedule or location of migrant transfers at this time,” says a press release.

Which begs the question: What should the federal government do with the tide of undocumented immigrants? Some churches and faith groups have extended a helping hand, and Immigration Control and Enforcement (ICE), which is charged with dealing with the migrants after they have been processed, says it has reached out to community groups and faith-based organizations in southern California to enlist their input and support.

But as news of the crisis on the border becomes more widely known, a backlash has built. Critics say Obama administration policy is to blame, suggesting that President Obama's efforts to ease deportation for young undocumented immigrants in 2012 sparked the surge.

“The Obama administration is being caught flat-footed here. They were warned by [the Department of Homeland Security] that there was a potential for this but didn’t act,” says Ira Mehlman, spokesman for the Federation for American Immigration Reform, which favors strict immigration laws.

This week, Murrieta has given voice to those allegations and frustrations.

At two meetings to hear the complaints of residents – one at City Hall Tuesday and one in a local high school Wednesday – dozens of Murietta residents stepped forward to say they felt compassion for the children’s plight, but worried about an irreversible increase in crime and the possibility of infectious disease if the migrants were allowed to enter their communities.

Carol Schlayfer of Pomona, Calif., said to the City Council on Tuesday: “We were declared a sanctuary city in the mid-'90s, and I want to warn you that the crime level in your city will elevate beyond your imagination, and the quality of life will deteriorate beyond your imagination. That’s how it works.”

On the dusty outskirts of town the same day, where about 100 protesters waved signs and cars driving by beeped in support, mother of four Ellen Meeks held a sign that read: "Help OUR government. Help house OUR children. OUR vets. Our Moms and dads. We need help here first.”

“One reason I moved out of Moreno Valley is because this immigration got out of hand. Well, I found out you can’t run from it. You have to speak your opinion,” she said.

Why are we taking these people in? There's no war in Central America, no one is being persecuted for their religious beliefs, nothing. And why don't they stay in Mexico? Because they all know Obama has rolled out the red carpet for them. While we're talking about this, all his other scandals have faded into the background.

Scotus on sb1070: the border is the responsibility of the federal government, whether they ignore it or not.

that ruling was the first step down a relatively short road that has led us here.
