Everything I've read in this story so far, says the ABC agents are at fault for mishandling the procedure.

that's for a judge to decide...

The judge decides whether or not the girl deserves financial response. That's not the same thing UM as just saying the agents aren't at fault for a bad response.

Oh bullschit. We all can, and do, make judgements on stuff all day long. Anyone with a modicum of sense can see what went down here and the sheer idiocy of these uniformed thugs you have chosen to defend. Lack of judgement on THEIR part, the supposed "adults" or "trained law enforcement professionals" brought all this on.

A box of freaking water. These dipschits don't know the difference between beer and water?

Time for a little more training, doofuses.

what amazes me about this story and comments from other people on this board with their personal experiences is that the ABC spends so much effort targeting college drinking.

seriously? of all the things law enforcement $$$ should be going towards this is at the bottom of the list. the ABC should focus on the moonshiners not this crap

All this because ABC thought the girls had beer. Wow. And as for them having badges and yelling Police doesn't prove that they are. I still have my ARFF badge from my retirement and that doesn't make me a cop. You can buy a metal looking one at the Dollar Store and if you use it at night you can play cop too.

The fact that they called this a "sting" should set off clues as to just how poorly run this operation was and that serious reprimands and lost jobs should occur as a result of the incompetence of those in charge of this Jackbooted invasion of privacy. An ALE "sting" involves having an underage person purchase booze and then busting the SELLER...not skulking the fck around in the damn parking lot. This was simply nothing more than a witch hunt and for damn sure sloppy and LAZY police work.03-puke

ALE is just as bad. One of my old roommates had a young alumni fraternity brother run into the store for him to grab a case while he sat in the car. The roommate was 21 but didn't have his ID on him. 3, count them with me.. 1, 2, 3, ALE cars circled the vehicle, one on each side and one behind, when the young alumni got in the car with the beer. Started banging on the doors, etc.

My worst run in with the ALE was a near miss...saw bluelights up the road for a traffic stop and took it as a sign. Sure enough 5 minutes later 2 blacked out 'burbs and an impala pulled infront of the house I was at and 10 officers swarmed the house screaming and yelling "GET ON THE GROUND, NOW!" Everyone under 21 got a drinking ticket. Only party I left early...what a premonition.

He is asking a rhetorical question. What if they are one day from 21? It is an arbitrarily set date. It has nothing to do with ones maturity in handling alcohol.

I'm trying to figure out how they got away with this one? To my knowledge it's not illegal to imbibe alcohol, only to buy it?

Well, they DO typically give you a choice- between a couple of rather schitty options. Either accept the citation (if you've been drinking underage at all) OR you are welcome to come down town with them, sit in the holding tank a couple/ few hours while they do "paperwork". Then they may call you for a blood test to determine whether you've been drinking or not. If so you may get a DIP-it's very low if you're underage, or you wait another several hours to "sober up" before you can call for a ride home at 8 a.m. Saturday morning.

So yea. Open container or other infractions like this, if you aren't completely totaled are usually around 25-50 bucks so not worth all the other hassle. People figure this out pretty quick.

No, but it has everything to do with legality.

It's the law...simple as that.

I'm not sure the legality of any of it. Our campus lawyer told us at freshman orientation that if we were ever asked to blow into a breathalyzer outside of a vehicle that we should politely refuse and move on unless we were seen drinking.

All I know is when they swarmed the house they yelled at everyone to get on the ground (the nasty, floor with beer spilled all over it). Then they tell everyone who's 21 to take out their ID and leave. Then they make everyone blow into a breathalyzer or simply write them a ticket if they admit to consumption. NCALE at it's finest.

RE: Bottle water purchase gets UVA girl 3 felonies
When I was a freshmen, there was this gas station in Harrisonburg right off of campus that didn't card anybody buying alcohol. Once word got out about it, this place was swarming with underage people buying booze Fri/Saturday nights. Eventually, ABC set up a trap and caught 12 underage people and issued citations before finally going in and busting the gas station and revoking their liquor license (and probably charge them with some sort of distribution to minors crime). I was always a little off put by the fact that they waited for 12! 12 freaking kids! before finally going in and busting the establishment. They must have some sort of quota they need to fill in college towns because that seems absurd to me.

Ironically, this place got their liquor license back within a year...Morale of the story? Virginia ABC does NOT MAKE SENSE.

I can't speak for elsewhere in South Carolina, and we aren't a college town, but the alcohol enforcement team here has primarily concentrated on businesses that sell to minors. When a friend of mine was working with them he told me they investigated complaints, and did undercover buys using Explorers from the participating agencies. The only time I ever heard him talk about making underage arrests was when they raided a huge party that the idiot high school kids made fliers and handed them out at school.
