On moving the thread. While I would love for threads like this to be in the OT section, I did make the promise at the beginning that I wouldn't move a thread to the OT board until it was waning in interest.

Seriously, though, can undercover cops legally enter a party without permission from someone who lives there? Would the leasing company be able to grant blanket permission for something like that if it's in apartments? More questions that get into way too many hypotheticals. Where are the lawyers on here?

If it's an open party, why wouldn't they be legally allowed to enter? I'd say that hosting an open party gives plenty of 'probable cause'. Most of the ODU cops I've seen are fat and middle-aged, so I'm not sure they will be so inconspicuous 03-lmfao

Agreed with Monarch Pride, but I see your concerns Superfan. An open party is an open party. Someone with an open container smoking a cigarette on the stairs outside of the party is enough probable cause to move in. Spotting someone who appears to be underage enter the party is also probable cause IMO. I doubt they are going to be ball busters. They aren't going UC to give underage tickets and noise violations. They're looking for something bigger.

I'm not a criminal lawyer, but I took it in law school (and stayed at a Holiday Inn Express). Honestly, Tat probably has the best response and more experience with that kind of thing - particularly with regard to probable cause.

I'll add that the homeowner does have a right to privacy absent probable cause but once you open up your home to the public, you start to lose your expectation of privacy. To what degree? Well, that's where it gets interesting. If the UC goes into a bedroom with a closed door, looks under your laptop and finds your coke, he's going to have to show probable cause to be looking there. If he walks into your open party and sees your coke laying on the kitchen table, have fun in federal pound me in the a$$ prison.

Obviously there's a number of scenarios along that spectrum that operate on a fact by fact basis.
