Do you have any idea of the DRM put in the Xbone? You will NEVER own any of the games you buy, its merely a license to play to the game indefinitely. No used games, no lending or borrowing games. They want to take away complete ownership of the games. Add to the fact you have Kinect always on always listening (sound familiar?). Sony is offering complete ownership of the games you buy and no ridiculous DRM, and its a 100 dollars cheaper with more superior hardware than the Xbone. Tell me WHY anyone should buy an Xbone? Look, I'm not huge fan of the DRM and the used game issues brought up here and everywhere else. To be completely honest, I have a pretty good feeling that Microsoft will give in to public pressure over this and do away with that policy.
That being said, Sony has been well known to do many of these same things. Sony was guilty of issues with the PII (personally identifiable information) they leaked thanks to their completely crap design of PSN and the rootkits they put on CD's (

As far as hardware goes, neither manufacturer ever actually maxed out the hardware in the current generation. While Sony's hardware may be "better," it is not lightyears ahead and since both are running on intel processors you will probably see all the developers develop towards the MS hardware. That way they know they'll have little to no issues when porting it over to the PS4 and PC (yes, these new generations of games will be a big shot in the arm for PC gaming since both companies are going back to the intel platform).
As far as differentiators, the xbox will almost surely be a more robust "entertainment" system that will essentially merge itself with your cable/satellite TV box, your netflix or amazon prime online videos, PPV, and other options. I chose the XB360 because of the media center capabilities. I have xb360's on all of my TVs, a media center PC I got for cheap on woot ($300), and 2 HD Home Run Network Tuners (allowing for up to 6 concurrent recordings/streams simultaneously). My cable TV bill is only $45 after all fees... half of what it was for the same package with a DVR and STBs. I paid within a year for the hardware through savings and now I have essentially unlimited storage space for DVR'd shows and digitized media (movies, music, and pictures). The XBox 1 will continue on that entertainment path, and probably by the time I'm ready to buy it will be the same price point as the PS4.
I certainly understand your concern about the kinect, but I have a pretty good feeling I can place the thing towards the wall and something over the microphone to keep MS from "listening" in, assuming they actually do that.
All that being said, I don't think a consumer can go wrong with either direction.
