Quote:Fine says he'll sue for defamation and seek undefined damages. He filed a "summons with notice" Nov. 15, 2012, in state Supreme Court in Onondaga County.

His lawyer, Richard Sullivan, declined to comment Thursday.

ESPN spokesman David Scott said the network doesn't comment on pending litigation and stands by its reporting.

RE: OT: Bernie Fine to sue ESPN for defamation
For those who stopped paying attention to this story, a refresher:

The third and fourth accusers recanted. The second accuser (who is the step-brother of the first accuser) swore up and down ten years ago that nothing happened, then suddenly changed his story a year and a half ago. He spent much of those ten years interacting with Bernie Fine...attending his 60th birthday and going to games with tickets supplied by Fine. He also said he was glad when their slander suit against Jim Boeheim was dismissed.

In short, all we're left with is the first accuser who ESPN, the Syracuse newspaper and a private investigator hired by Syracuse University decided wasn't credible when he first started making these claims in 2003. The only reason anyone heard about this is he talked his step-brother into lying for him.
