The "mutual commitment agreement" is the technical name of the Pre-Nup. So Houston knew. Which means that SMU and UCF knew--it defies belief that Houston would have been told, and expected to keep it secret from SMU and the other new members.

Not that anyone cares anymore, but I just found it.

EDIT: Also, Houston had to have been told about the Tulane/ECU membership vote. In section 6, it specifies that UH will receive notice of and will attend but not vote at, meetings about the TV contract, new members, and changes to the bylaws/constitution. The Conference will give "due regard" to Houston's views before voting--I have no idea what that means legally.

So assuming this document holds legal authority over the Big East by-laws...it looks like the Big East will remain the Big East as long as they want the name, which Aresco clearly stated that they do. Perhaps if the Boise St., SDSU, and a full western division had come to fruition than the remaining Big East schools would have negotiated a hefty fee to let the C7 take the name with them, but alas it did not.

So assuming this document holds legal authority over the Big East by-laws...it looks like the Big East will remain the Big East as long as they want the name, which Aresco clearly stated that they do. Perhaps if the Boise St., SDSU, and a full western division had come to fruition than the remaining Big East schools would have negotiated a hefty fee to let the C7 take the name with them, but alas it did not.

But I proved the prenup existed. We don't know exactly what is in it though.

I know this is an old post but Houston wouldn't have had to tell SMU, UCF or Memphis anything. I'm pretty sure the Big East didn't let Houston in on the conference secrets while keeping the others out. The language about the MCA as well as the portion in Section 6 would most likely have appeared in all of their contracts. They all knew about it and ECU/Tulane vote. USF and UCF were actually playing active roles in getting ECU aboard.
