It looks as if she followed the city statute in regard to her garden. I hope she gets restitution for this crime...but...I doubt seriously she will. Next time... limit the plants to the back yard. One of her neighbors used the violence of the state to do something they were too cowardly to do themselves. My guess it was the one directly across the street with the manicured lawn.

The HOA's stock and trade is to make neighbors complain about their neighbors. It provides cover for enforcement of their shady and vague rules. Their real goal is to generate revenue, not protect property values.

Was this a HOA situation? I thought this was a city statute situation.

Personally...I totally approve of HOA's. It is a freely entered covenant with your neighbors when you buy the property. One should honor their contracts and I have not sympathy for those that break them. I agree though.. that often the HOA's get crazy with some of the things "added" to the covenants later by control freak neighbors who get power on HOA board. That is why one should always be careful when entering into a HOA situation. It is good to ask long term residents about the HOA and its history of "enforcement". Some of these things are so restrictive that it is insane.
