Well, the law sees how it is possible. If you are defending your life (or just property in some states) you won't be charged. It's usually pretty clear. This case is somewhat fuzzy though. I believe he should have been arrested. Doesn't look like anything will stick anyways.

She shouldn't be arrested. Neither should someone else who is so clearly protecting their own life from an aggressor. Thankfully it won't happen very often. To try someone defending their life for such a serious crime is political suicide for the official doing so.

Oh, I didn't say I thought she should be arrested. But I just don't agree 100% with the thought of letting someone who kills someone else regardless of the incident go without a "second thought". You are correct.

Yea because being raped and having the guilt of taking a life are not enough... Lets put her through a trial as well!

And nobody has said it should not be investigated, nobody! Whats been said is only arrest when you have a charge and some reasonable evidence to that charge.

Good question. Someone kills someone else, be it the woman being raped or George Zimmerman. In my opinion, the police should investigate the facts first (i.e. woman is being raped, obviously bad; Martin/Zimmerman fight? what actually happened isn't clear to public now) and assess the situation as it goes. Woman being raped kills her attacker wouldn't be a murder charge, but she could be tried with voluntary manslaughter rather than a more serious charge. The court could decide for sure whether to convict for voluntary manslaughter (which might not be too likely if she was raped). I think regardless of the manner in which something "goes down" it should always been investigated as what it is: a killing.

Don't get too upset! My point was that a killing is a killing and I don't think it should simply be pushed off without a "second thought". A woman being raped manages to escape by killing the man... that's still killing someone. What's worse, being raped or killing? I know I'm playing "devil's advocate" a bit here - some things are obviously terrible, but if one bad thing happens (rape) as does another (killing) does that one just get "wiped out" by the action of the first? I wasn't saying that a woman being raped that kills her attacker should be thrown to the sharks, just that I don't believe that she (anyone, actually) should get off with no strings attached after ending someone else's life.

If you're saying all shootings should be investigated thats one thing. If your saying charges should be filed then thats a different issue.

Clearly there was investigation on this shooting. He was treated by paramedics, taken to the police station asked to give a statement. Meanwhile the police took some other statements.

In fact we don't know where this was before the media blew it up.

If it can be shown the police just pulled up, said "yea that sounds right" and let him go then the police need to be looked at.

A woman being raped manages to escape by killing the man... that's still killing someone. What's worse, being raped or killing?
