I'm not sure if that is discrimination or not. Is stupid a protected class?

Well, no. Stupid people do get a free Line-Ox bedliner, and all of the SEC merchandise they can steal from Wal Mart. But no, they do not have a right to work for me, yet, so far as I can tell.

I'm betting he is in breach of any contract he is under for recruiting services at minimum. I'd also argue that this pretty much shows he isn't very good at his job if he can't separate sports from real life.

Seems to me that you are setting yourself up for some bad karma... I hope you never end up in a competing situation where you lose out on the hiring bonus because you threw out a resume for the candidate who won.
