Yep. Another board I go to (http://www.thecollegegridiron.com) got ordered by the NCAAssholes to change their name (http://www.ncaa-football.net) because it violated some...I don't know what it violated.

But, it did, and the board owner did just that.

The NCAAssholes can go fly a kite in a thunderstorm with gasoline boxers on.

I teach media law, and I'm pretty certain there's no law that the domain name of this board violates. It's not being run for profit, it doesn't pass itself off as an official NCAA site, and near as I can tell, it has no intentions of doing either.

This is just the NCAA flexing its retarded muscles.

Sort of like when Disney sent my church a cease-and-desist letter because it called the children's ministry "Adventureland." We ignored the letter, and we never heard back from Disney.

Generally in cases like this, the bullying organization sends a nasty threatening letter to the little guy. The little guy, GTS in this case, generally counts his money and says "Hmmm, the NCAA has lawyers on retainer and very deep pockets, I can't afford to fight this whether I could win or not."

Good for you GTS, and everyone who pitches in to the bully. F the NCAA and feed them fish heads.

Site generates money, site uses NCAA trademark to generate said money, site violates trademark law. Unfortunately, the NCAA will be able to afford lawyering this into oblivion, so I'd be registering some backup domains and promoting them ASAP.

I had to think about that. I had almost forgotten that unregistered users see Google ads.

The site certainly doesn't generate a profit for the Admins but it does have ads.

That's the kicker. While it may not generate a profit, it's generating revenue, period. They'd probably eventually get around to complaining about it regardless of the revenue, anyway. Trademark lawyers are pretty relentless.

That's not the way it works. To satisfy ACPA, the domain must have been registered in bad faith with the intent to dilute/profit off the mark.

I suggest reading case history, particularly Razorbacks.com and the MLB against a number of fan forums.

While they cannot take BlazerTalk, the case has implications for the BlazerTalk name, and indeed pretty much all collegiate sports forums.
