I think the document you actually quoted is the act of congress admitting Texas as a state, but IIRC the wording conforms to the treaty that was executed. You raise one of several interesting if esoteric legal issues involved here--since the Republic of Texas no longer exists, exactly who are the proper parties to the treaty? A group of nuts thought they were the Republic of Texas, and they camped out in the boonies near Marfa a few years ago. My old friend Terry O'Rourke had to go out and talk them out of it.

Technically, the Constitution is illegal. We're still under the Articles of Confederation because we never had all 13 original states vote against them and in favor of the Constitution. It's the dirty little secret that lawyers just have to avoid. 05-stirthepot
