NCAA will re-hear Mauk's appeal

The NCAA will re-hear Mauk's appeal, according to NCAA spokesman Erik Christianson. No word yet on when that will be, but it's expected to happen before the weekend. My guess would be Friday.

"We will re-hear the matter," Christianson said in an e-mail. "The NCAA’s procedures allow for its hearings to be reopened in certain circumstances, such as to hear new evidence not previously available. The NCAA’s preference is always to explore all possible administrative remedies rather than have a court try to intervene in decisions of its member schools’ representatives, as our member representatives have the expertise and experience to best deal with such situations."

I wonder if they'll do the same for Mike Cook of Pitt. I wish Mauk the best in whatever the outcome is.

I don't see how they could overturn Cook's decision. Is there evidence they can present that he played in fewer games?

I think this is just to avoid any bad publicity from the lawsuit. It's a preemptive strike, and will probably not change a thing. But it will take time, and by then it will be too late for Mauk to do anything except watch UC's games play on without him.

It's not to late, he has been practicing all Summer so if a miracle happens and it's overturned he'll be able to play the game. The NCAA screwed up by not even letting him talk to them, which I thought was stupid. I guess they were afraid that he would provide compelling evidence and they might be forced to go against precedent or something.

Even if cleared, he won't see any meaningful action for at least two weeks. He wasn't exactly in shape, as he, in fact, HADN'T been practicing. How could he get reps with the case (at the time) unresolved?

It will be if they deny him again. How long do you think it would take before any other actions are initiated? Nothing in any beaurocracy moves quickly.

The NCAA agreed on Wednesday to re-hear Mauk’s appeal for a sixth year to complete his four years of eligibility. If the appeal reaches the Student-Athlete Reinstatement Committee, which ruled against Mauk on Aug. 8, Mauk has been assured that he will be given a chance to speak, something that he was not allowed to do the last time. But Kevin Murphy, Mauk’s attorney, said he hopes the matter never reaches the committee. “The (NCAA) staff is going to hear it first,” Murphy said. “If the staff agrees with us, he’s back on the field.” The NCAA already ruled against Mauk once before he filed for an appeal hearing, but this time Murphy said Mauk will submit new information. No date has been set for a hearing. “All the details are not ironed out,” Murphy said Wednesday afternoon. “We’re trying to get the case submitted to them through the University of Cincinnati by tomorrow night if we can. We’re planning on working all night to get this done. “We’re giving them additional information about the injury itself. We have an expert, a physician who’s going to explain the injury, the medical picture.” NCAA spokesman Erik Christianson said in an e-mail that “the NCAA’s procedures allow for its hearings to be reopened in certain circumstances, such as to hear new evidence not previously available. I saw if in that article a bunch of times. That's a mighty big word for a season to hinge upon, especially when you're depending on the outcome of that if from an NCAA committee decision...

I had to submit the same information over and over to Social Security when I applied for disability. It seemed like every person who viewed my records either lost them, or kept them. At any rate, the same information was requested so many times I scanned it and just resent the entire scanned archive folder for every request. It worked.

I wonder if the NCAA has just as efficient as the Social Security Administration at record keeping? 03-banghead
