Two teenage boys who cut off the head of a corpse and played with it in a graveyard today escaped a jail term.

Sonny Devlin, 17, and a 15-year-old, who cannot be named for legal reasons, were both given probation at the High Court in Edinburgh today.

They were accused of cutting off the head and playing with it in a graveyard tomb at Edinburgh's Greyfriar's Cemetery and were subsequently found guilty at a trial in March.

They were convicted of the ancient crime of violation of a sepulchre in a historic case. The trial was the first of its kind to come to court in Scotland for more than a century.

Devlin, from Edinburgh, was sentenced to three years' probation with the condition that he carries out 200 hours of community service.His 15-year-old accomplice was given two years' probation.

The pair, both from Edinburgh, were found guilty of forcing open the Mackenzie Mausoleum in the famous cemetery, where Sir George "Bloody" Mackenzie, a former King's Advocate during the reign of Charles II, was laid to rest in 1691.

The identity of the corpse is not known, but it was in a mummified state and was thought to have been there for many years.

During the three-day trial, witnesses told the court that the pair had been with a group of friends in the city's Bristo Square on the night of the offence, June 30 last year.

Some of the group, including Devlin, had been drinking alcohol before they moved on to the cemetery where the two committed the offence, the court heard. Unemployed Devlin was on bail at the time.

"Without your participation, the crime may not have been committed."
