I can dream up two possible paths, but I have no idea if either or both would be laughed out of court. They both sort of follow the same reasoning:

1) Idaho deliberately misused donation money, by refusing to follow the wishes of the donors
2) Idaho deliberately misused public money, against the best interests of alumni, and of the state in general
