I think the way forward with FCS is to have a pre-season game against a FCS instead of a spring game. It won't count in the standings. But it can be sold with season ticket packages and/or as an individual game ticket.

The NCAA doesn't permit FBS teams to play D-2 or D-3 opponents. If some state were to "require" that they do, it would have no effect. The only thing a state could legitimately do would be to require that they play one if it were allowed. I suppose, technically, they could also require that a state supported school drop down in NCAA class, but that certainly wouldn't ever fly politically. Those legislators would quickly become former legislators.

I see no reason why Clemson and South Carolina's requirement to play a game against an in-state FCS team wouldn't be satisfied if it were a pre-season exhibition. That's the best solution to a lot of scheduling problems, IMO.
