Well it would not matter if the house was in her name, or in their name, once Joe-Pa died. My house is in both our names and if I pass tomorrow it will not be part of my estate, it will become my wife's asset.

Now if Paterno was alive then this is a different story..

As to the death penalty I believe "lack of institutional control" applies here. Is it worthy of a death penalty? Well I don't know enough to say that but clearly PSU could be sanctioned for this.
