Syracuse ,Pitt & Notre Dame weren't members at the time of this court case& won't get any of it

Syracuse and Pitt signed up for an ACC with Maryland. They have every right to be compensated for increased costs, especially since legal costs were borne while they were members. Is this written somewhere or speculation?
