Why on EARTH would you fight this if you were PSU? Now you just got sealed documents unsealed and all the dirty laundry is out.

Sandusky’s finger penetrated the boy’s rectum, Doe testified in court in 2014, and the victim asked to speak with Paterno about it. Doe testified that he specifically told Paterno that Sandusky had sexually assaulted him, and Paterno ignored it.
“Is it accurate that Coach Paterno quickly said to you, ‘I don’t want to hear about any of that kind of stuff, I have a football season to worry about?’” the man’s lawyer asked him in 2014.
“Specifically. Yes . . . I was shocked, disappointed, offended. I was insulted. . . I said, is that all you’re going to do? You’re not going to do anything else?”
Paterno, the man testified, just walked away.

At this point, it should just be left in the criminal or civil court system, and the NCAA should stay out. They already gave PSU sanctions when their jurisdiction over the entire case was questionable, and rescinded some and ended others early.
They have jurisdiction over lack of institutional control only (in my opinion) and handed down their verdict, and changed their mind. No double jeopardy here. Let the court case play out.

Huh? There is no mention anywhere about the NCAA here. This is an article about PSU's lawsuit against it's insurance company.

At first blush, that is exactly the implication. Although depending on the state laws, the rape shield could have been expanded to cover testimony given by victims' family members.

As much as it would hurt the B1G and Rutgers (in terms of terrific rivalry potential), Penn State football should have gotten like a decade-long death penalty once the Sandusky case was revealed. There really is no excuse for the weak penalty they got in terms of the crimes that were committed for decades.

The sanctions they had were impossible. Basically a more standard 3 years of probation, maybe a schollie or two for a couple years and postseason ban for a couple years was the most they could've done (and it's basically what happened in the end).

Just my opine, but the NCAA should never give sanctions again to the depth that State Penn got them -- it turns the program into effectively an FCS squad and sets up the possibility for serious injury for the student athletes, playing 11 or 12 games against full squad teams, possibly for years on end.
Because of how the rules were written PSU couldn't get the death penalty, but you either have to shut the program down, with a plan to bring it back gradually (escalating through the ranks as you rebuild) or penalize in some way other than loss of scholarships, or force the school to play an independent schedule similar to a team in FCS to FBS transition. Hopefully this situation never presents itself again.
