So says Greg Flugaur (@Flugempire).

NCAA ByLaw 20.02.6 say a FBS conference needs 8 members.

The implication is that if 3-5 teams leave the Big 12, ESPN/Fox have the power over the others about whether they even remain a conference. Whether the remaining schools can enforce the GOR at all.

If Oklahoma, Kansas and Iowa State leaves for the Big 10 now, and Texas go Independent? West Virginia, Kansas State, Baylor, TCU, Texas Tech and Oklahoma State is screwed. I think ESPN had something to do with blocking the Texhoma 4 from going to the PAC 12. They would have lost money to CBS and PAC 12 Network. That is why schools like Boise State, BYU, San Diego State, Colorado State, UNLV, New Mexico, North Dakota State, Houston, Tulane, Memphis, Northern Illinois, Toledo, Cincinnati, U.Conn, UCF, USF and East Carolina are on the expansion list. ESPN really does not have any west coast content except for Boise State and BYU at their expense.

That is different since what I'm saying isn't dealing with a conference network. Adding two more teams adds a conference champ game (big ratings for the network that gets the rights) and more content that will lead to more viewers on FOX and ESPN.

Who knows how the LHN and a Big 12 Network is going to play out. That stuff is messy and a lot of ego power people with that.

IF that 8 team minimum is required to keep the GOR in force than ESPN can kill off the big 12 pretty easy.

Example 1

WVU to the ACC
OU and OK state to the SEC

Example 2
WVU to the ACC
KU and OU to the big 10

in either case, the big 12 drops below 8 football members and becomes invalid. If i were ESPN, i'd go with example 2 and cut a deal with the big 10 on their upcoming deal. Yet, i would also add uconn and cincy to the acc and shift 2 acc school's over to the sec. Thus, the big 10, sec and ACC would all be at 16 members. After those moves, the big 12 would be at 7 members. ESPN could try to cut a deal with the pac 12 and texas to get the pac 12 up to 16 with texas, texas tech, x and x. OR ESPN could just rebuild the big 12 into a Longhorn conference if everybody signed off. Add houston, colorado state and BYU to get back to 10….could go total texas and bring in SMU than hit fl with UCF and/or USF…lots of school's to rebuild to 10-12 members. My guess is texas would probably go indy in football, maybe a BYU football only invite to offset it and eventually move to the pac 12. Yet, the Longhorn league could last for a few years with texas collecting its LHN money and the other losing the right to sue.

The Networks have the right to protect their Grant of Rights. If they want to sell their rights they can and they can trade them if they want to.

The schools sign off their rights to the conference, the conference signs with the networks. Networks are not in contract with individual schools (except for Notre Dame).

If you're going to argue that it's unbreakable then doesn't it hurt your argument to say flat out that the grant is to the network?

If that were the case then wouldn't a move to another conference where said network also owns the rights be a "simple" lateral move?

Yes a conference can go after a school if they left since the conference is contracted with the network that stats x and y is protected for the network and the school has turned over their rights to the conference.

If anyone tried to leave a conference on their own, the GOR is going to be activated and that school will likely wished they never left since they will be sued for so much money and be in court for years.

Not really. Now ESPN/Fox could diminish how much they pay. But it doesn't mean the conference doesn't exist. And it doesn't have anything to do about the GOR.

You are getting pissy because you are wrong. The networks have rights protected for x and y. The conference signs with the network. The schools turn over their rights to the conference, which in turn is in contract with the networks.

The networks have the power to sue a school up the but so far they could bankrupt a major university.
