Here's one of the hard-hitting questions a Republican Senator (Jeff Flake-Arizona) asked Gorsuch today.

"Would you rather fight 100 duck-sized horses, or one horse-sized duck?"

Sorry the Democratic Senators couldn't have thrown up a few softballs like that to Gorsuch instead. Gorsuch is doing a nice job in his hearing. Not nearly as flawless as Garland was in his hearing but close.

Politico was floating a deal of sorts that the Democrats promise not to filibuster if the Republicans promise not to use the nuclear option for any additional SC nominees that might come up in the next four years. I'd be fine with that - Scalia for Gorsuch is a reasonable trade. But I'd be very concerned who they might want to replace a retiring Ginsberg with as an example.

I'd also tell them that if they pull this stunt on a guy they unanimously supported in 2006, when Ginsberg kicks or Kennedy retires this summer they will appoint Ted Cruz by simple majority vote and let him set legal precedent until 2050.

I'd not make the promise because, well, Trump may only get one term and I'd like him to replace two justices (Scalia and one other) with originoalist.

Also... At some point the GOP will be back in the minority, the pendulum always swings. That's what made the whole Biden Rule so delicious.
