I had already thought it before, but saw a tweet this morning saying that boosters told Mackin they would pay his salary for five years and offer protection for 5 years if he would speak out and he said he couldn't.

Also saw another tweet that said Mackin was given a $50,000 RAISE even though no longer AD. True?

If either or both of these are true, there's smoke. Media needs to find the fire.
The boosters maybe can't make him speak, but I hope someone with legal authority does.
Grow a pair Mackin. For the first time in a while you have a chance to do right, and it won't hurt you financially. You can do the right thing. You can tell everybody what really happened and get out of town. Nobody wants you here as it is, take the boosters offer and figure things out after you talk.
If he signed an NDA, five years salary and "protection" may not overcome the penalties within the NDA.
He can't speak under an NDA. He'd *have* to speak if subpoenaed.
Wouldn't the NDA itself be a matter of public record? It would be interesting to see what the terminology is within it. Since it would be a civil matter, I would assume that the extent of the punishment they could pursue would be the actual provable dollar value of injury to UAB by his violating the NDA. That's what I like to refer to as a "giant gray area"...
Well then how do we get these people subpoenaed?
NDA's for public employees should be illegal. Talk about protecting a back room deal gone bad???
He's a coward just like Watts...He got his 30 pieces of silver, and don't let Carr and ASSociates off the hook, either! If they signed an NDA, they're just as complicit, no?
Could it be that Mackin got paid on the side as well?

I think we suspect the answer to that.

Complicit yes, but should they be on the hook? It really depends on what they were contracted to do. If they were asked to help kill football, they played their part. Further, if the data were provided for them by the athletic department, it's not Carr's fault that the data were misleading, inaccurate, or irrelevant, i.e. from last year instead of this year.

With the circle of NDAs, it's going to be hard to figure out whose fault it is.

The dollar amount for all of the non-disclosure agreements needs to be factored in to the cost-benefit analysis of discontinuing football. That combined with still paying out all of the coaches' contracts and all of the athletes' scholarships, and buying out all of the nonconference games, this has got to be hemorrhaging money in the short term.
It would be interesting to get a list of persons under a NDA for the UA system(FOIA). I imagine it will be pages long and well into the millions of dollars...
I would love to see that list. I would also love to know how many stadiums we could build with they money they pay to cover up their sins.
Brian was a teammate of mine, we are all so DISSAPOINTED in him. I'm hopeful he will one day speak, but I just don't know. He has been thrown under the bus by Watts. I sent him a message that Coach Harry "the Hat" Walker is rolling over in his grave at his silence.

There are a lot of UAB folks that have chosen money over dignity.
I don't know what to make of Mackin. I haven't participated in the criticism of his action or nonaction. I think he had the same vision, passion, and strategic plan as Carol Garrison, but got caught between a rock and a hard place. First, I think he was upset when the stadium proposal (that he must have worked very hard on for a long time) wasn't allowed, not even for a vote, and then came Garrison's departure and the installation of Watts and his true agenda. Mackin may have also been deceived, like Bill Clark, about the true purpose of the "study", thinking it was a good thing, and then at some point saw the writing on the wall and tried to trade the death of football for increased spending on other sports and then ultimately he went into CYA (cover your a$$) mode.

This couldn't have been easy for him.

(of course, we don't know if he doesn't end up with a check from Bryant Bank on a regular basis, either)
If he came forward as a whistleblower to illegal activity then the NDA is not valid.

He better be lawyered up with some deep pocket support or the illegalities will never see the light of day.
If he basically got hoodwinked and backed into a corner where his only out was signing a NDA, there'd still be ways to leak out info to blow this open. That's why I think there's some culpability on his part. I just can't imagine not fighting tooth and nail for something I love of I'm in a position like he was/is.
